Moving beyond specific contracts between the tribes and the Secretary of the Interior, Congress authorized a five-year research and demonstration project, whereby a limited number of tribes could plan and administer programs and services, including redesign of programs and reallocation of funds.

  • Clarifies intent of PL 93-638 in attempt to address concerns with Title I.
  • Adds Title II and Title III
    • Title II – Ensures tribes’ sovereign immunity from suit and ensures trust responsibility is not terminated
    • Title III – Establishes a 5-year self-governance demonstration project within DOI and expands the type of programs and functions tribal governments can take over, minimizes oversight by federal agencies, maximizes flexibility for tribal governments to redesign and reallocate.
